Terms and Conditions

Welcome to Call My Ride, a transportation service provided by GBDC Entrepreneurship Institute, a 501(c)(3) Non-Profit company based in Florida. By accessing or using the Call My Ride mobile application provided by ATOM, you agree to comply with and be bound by the following terms and conditions of use. Please read these terms and conditions carefully before using the App.

1. Acceptance of Terms: 
By accessing or using the Call My Ride mobile application (the “App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App.

2. Services. 
The App facilitates non-emergency transportation services for sponsored individuals or organizations in South Florida communities. Users can arrange transportation and logistics through The App or website for personal, noncommercial use. Call My Ride grants users a limited license to access and use the applications and related content solely for personal, noncommercial purposes, subject to compliance with the Terms. Restrictions include prohibitions on altering or exploiting the Services beyond permitted use, as well as accessing or impairing related systems or networks. Third-party services and content may be integrated, with separate terms and privacy policies, for which Call My Ride assumes no responsibility. Ownership of the Services and related rights belong to Call My Ride, with users granted limited rights under the license, excluding rights to Call My Ride’s intellectual property.

3. User Requirements. 
Users must register for an account, providing accurate information, and must be at least 18 years old. Passengers under 18 years old will need written consent from parents and the app must be installed on the parent’s phone and not the child’s. You may not assign or otherwise transfer your Account to any other person or entity. You agree to comply with all applicable laws when using the Services, and you may only use the Services for lawful purposes (e.g., no transport of unlawful or hazardous materials). You will not, in your use of the Services, cause nuisance, annoyance, inconvenience, or property damage to the vehicle  or the driver In certain instances you may be asked to provide proof of identity to access or use the Services, and you agree that you may be denied access to or use of the Services if you refuse to provide proof of identity.

4. Booking and Payments:

  • Rides must be booked a minimum of 12 hours in advance. Users can book rides through the App and utilize funds from their assigned wallet. Rides are charged at flat fees plus mileage, with rates varying based on the type of service required (ambulatory, wheelchair, stretcher). A discounted monthly subscription option is available for $100 per month, with a $5 administration fee charged monthly. Unused funds roll over to the following month.
  • Charges are final, non-refundable, and may include taxes. Call My Ride can adjust charges at its discretion and may inform you of changes. Promotional offers may affect charges, but your use won’t be affected. You can cancel service requests up to 2 hours before the driver arrives, with possible cancellation fees. Charges don’t include tips for drivers, which are voluntary. After service, you can rate your experience and provide feedback.
  • You’re responsible for repair or cleaning costs for damage beyond normal wear and tear to driver vehicles caused by your use of the service. If a repair or cleaning request is verified, Call My Ride may charge your designated payment method to cover the costs, which are non-refundable. 
5. Passenger Limitations: 

The capacity of each van is 6 passengers. Group rates apply for three or more passengers. Multiple pick-ups or drop-offs are not permitted unless all passengers share the same pickup and drop-off location.

6. Cancellation Fee: 
Users are responsible for providing accurate booking information, including pickup and drop-off locations. Any changes or cancellations must be made at least 12 hours before the scheduled ride. Failure to adhere to these guidelines may result in penalties or additional charges.

7. Text Messages. 
By creating an Account, you agree that the Services may send you informational text (SMS) messages as part of the normal business operation of your use of the Services. You may opt-out of receiving text (SMS) messages from Call My Ride at any time by sending an email to info@callyyride.org. You acknowledge that opting out of receiving text (SMS) messages may impact your use of the Services.

8. Promotional Codes. 
Call My Ride may issue promotional codes for Account credit or other benefits, subject to specific terms. These codes must be used lawfully and as intended, cannot be transferred or sold, and may be disabled or expire at Call My Ride’s discretion. Call My Ride may withhold or deduct benefits if the code use is deemed fraudulent or in violation of terms.

9. User-provided Content.
Call My Ride allows users to submit various types of content through the Services, such as text, audio, and visuals, including feedback, support requests, and competition entries (“User Content”). While you retain ownership of your User Content, by submitting it, you grant Call My Ride a broad license to use, modify, and distribute it without further notice or payment. You confirm that you have the necessary rights to grant this license and that your content does not violate any laws or third-party rights. Call My Ride reserves the right to review and remove User Content at its discretion without notice.

10. Network Access and Devices.
You are responsible for having the necessary data network access and compatible devices to use the Services. Your mobile network may charge fees for data and messaging. Call My Ride doesn’t guarantee the Services will work on all devices and warns of potential malfunctions and delays due to internet and electronic communication issues.

11. Limitation of Liability. 
Call My Ride specifies that it shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages resulting from the use of the services, even if they have been advised of such damages. They disclaim responsibility for any damages related to users’ use of the services, any transactions with third-party organizations, or delays beyond their control. The company’s total liability is limited to $100. It clarifies that while users can utilize its services to request transportation, goods, or logistics, it bears no responsibility for any issues with those services provided by third-party providers, except as stated in the terms. These limitations do not affect users’ rights as consumers under applicable law.

12. Indemnity.
Users agree to indemnify and absolve Call My Ride, its officers, directors, employees, and agents from any claims, losses, liabilities, and expenses, including legal fees, arising from their use of the services, breach of the terms, Call My Ride’s use of their user content, or violation of third-party rights, including those of third-party providers.

13. Intellectual Property: 
All content and materials available on the App, including but not limited to logos, text, graphics, images, and software, are the property of Call My Ride or its licensors and are protected by copyright, trademark, and other intellectual property laws.

14. Privacy Policy:
By using the App, you consent to the collection and use of your personal information as described in our
Privacy Policy.

15. Modification of Terms: 
GBDC Entrepreneurship Institute 501(c)(3) Non-Profit reserves the right to modify these Terms and Conditions at any time without prior notice. Your continued use of the App after any such changes constitutes your acceptance of the new Terms and Conditions.

16. Termination: GBDC Entrepreneurship Institute 501(c)(3) Non-Profit reserves the right to terminate your access to the App at any time for justifiable reasons without prior notice.

 17. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

18. Other Provisions: Copyright infringement claims should be directed to Call My Ride’s designated agent, and notices can be given via the Services or email. Users cannot assign or transfer their Terms without approval, and the Terms constitute the entire agreement between users and Call My Ride. CALL MY RIDE GUIDELINES FOR LAW ENFORCEMENT AUTHORITIES

The following guidelines are intended to inform law enforcement about the legal process for seeking records from Call My Ride. These are merely guidelines, and this information may change at any time. For private party requests, including requests from civil litigants and criminal defendants, we recommend browsing Guidelines for Third Party Data Requests.

What is Call My Ride and what records do we have?

Call My Ride is a non-emergency  transportation carrier, Users can use the Call My Ride App to request transportation via their smartphone, the web, or via SMS. Call My Ride users can choose from a variety of drivers available in his or her location. At the end of the ride, user receive a copy of the fare receipt. More information about our services is available here. We store and maintain information as described in our Privacy Statements and our Terms of Use.

What type of legal process does Call My Ride require before producing user or partner information?

For U.S. Law Enforcement, we require valid and sufficient legal process before we can disclose business records regarding partners, users, or trips. In most instances, we won’t be able to provide any information without a valid subpoena, court order, or search warrant. We accept law enforcement requests via email to info@Call My Ride.org or via personal service through our corporate agent, GBDCE 1500 gateway Blvd #220 Boynton Beach Fl 33426. Our acceptance of legal process does not waive any legal objections Call My Ride may have and may raise in response to the request.

What form of requests does Call My Ride require, and how are requests processed?

To respond to a request, we will need to receive the applicable process described above, as well as a valid return email address from an official government domain. We review each request for facial and substantive validity, and will reject requests that are not facially and substantively valid. Among other things, we require requests to be narrowly tailored to a legitimate law enforcement need and will reject overly broad, vague, or unduly burdensome requests. In order to make sure your Law Enforcement Request is valid and does not seek more information than necessary, we ask for the following: A sufficiently narrow/defined time period; A specific event or action that the subject took; A specific reference (i.e., you must uniquely identify a user) We disclose data to law enforcement when we determine that we are required to do so by law. In those instances, we will search for and disclose data that we are reasonably able to locate and retrieve.

How does Call My Ride handle emergency requests?

We have a process for evaluating requests on an emergency basis where there is an emergency that involves protecting a user, driver partner, or third party or stopping illegal activity that poses an immediate threat of death or serious bodily harm. Requestors must submit an Emergency Request Form (which can be requested through info@CallMyRide.org) that describes in detail the nature of the emergency, and we review these requests on a case-by-case basis. Law enforcement can submit an emergency request by emailing info@CallMyRide.org. Please note that we will only review and respond to emergency requests from law enforcement, and will not respond to emergency requests sent to this address by non-law enforcement officials. Non-law enforcement officials aware of an emergency situation should immediately and directly contact local law enforcement officials.

Does Call My Ride notify individuals of a law enforcement requests for information relating to them?

Yes, we may notify subjects before producing their information to law enforcement, unless we are prohibited by law from doing so, or in exceptional circumstances such as emergencies. Law enforcement officials who believe that notification would jeopardize an investigation should obtain an appropriate court order or other appropriate process establishing that notice is prohibited.

Does Call My Ride provide a certificate of authentication or expert testimony?

We may provide a certification from our records custodian but are not generally able to provide in-person or expert witness testimony. Law enforcement officials with questions about these guidelines should email info@CallMyRide.org. Please note that we will not respond to non-law enforcement inquiries received at this email address.
